Shipping & Return/Refund Policy
Wine Shipping Policy:
- Shipping costs include the appropriate wine shipping boxes, UPS Shipping (calculated) and insurance. Selected items may have free shipping.
- We ship from 93703 in California.
- California customers: can select UPS Ground (the most economical) and expect delivery from 1-2 days.
- We recommend that you designate a business address as the ship to address, where a person over 21 years of age will be present to sign for the delivery.
- Notice, due to the constant changes with alcohol shipping laws in every state, Nick's Wine Corner can only ship wine on your behalf to: Alaska, Arizona, California, Colorado, Connecticut, District of Columbia, Florida, Georgia, Hawaii, Idaho, Iowa, Louisiana, Minnesota, Missouri, Nebraska, Nevada, New Mexico, New York, North Dakota, Oregon, Virginia, Washington, & Wisconsin.. If you do not live in one of those states you will not be able to checkout of our system.
- Recipient MUST by law sign for an alcohol delivery. A valid picture ID must be provided. When your alcohol order is delivered to you, you will be required to show identification proving that you are at least 21 years old. All orders legally require: Drivers License, Military, Passport, or State ID. The buyer of all alcoholic beverages is representing that he/she is acting in compliance with his/her local and state laws regarding the purchase, transportation and delivery of alcohol. The buyer represents that he/she has obtained any required permission, paid any required fees, is working through properly licensed intermediaries where required, is legally entitled to take possession of alcohol and is legally entitled to take quantities ordered. All Alcohol is sold in CA, and title passes to the buyer in CA. We make no representation to the legal rights of anyone to ship or import alcohol into any state outside of CA. The buyer is solely responsible for the shipment of alcohol. By placing an order, you authorize us to act on your behalf to engage a shipper to deliver your order to you.
- Indemnification: Buyer agrees to indemnify, defend, and hold harmless NicksWineCorner.com (a California corporation), and its affiliated companies, their officers, directors, employees, agents, and their successors and assigns, from all claims, demands, expenses (including reasonable attorneys’ and consultants’ fees), liabilities, penalties, costs, causes of action, enforcement procedures, and suits of any kind or nature (hereinafter “Claims”), of which NicksWineCorner.com may hereinafter incur as a result of Buyer’s breach of this Agreement, or performance of its obligations under the Agreement, or its or non-compliance with any laws and regulations applicable to the transportation of NicksWineCorner shipments, whether such action is brought by a governmental agency or other person or entity..
- Extreme Weather: Nick's Wine Corner assumes no liability for wine damaged due to poor weather during transport. This can include leakage or corks pushing out of the neck as well as "frozen wine pops". So, be sure of shipping conditions before placing a ship order. If you choose a shipping option, WE WILL SHIP regardless of conditions in your area, so be careful. Please take advantage of our FREE SUMMER or WINTER STORAGE program if you are concerned about high and low temperatures during shipping. (Minimum 6 bottles) up to 3 months.
- Original wooden crates: if available and requested, can be shipped Ground for a $10 fee per box (regardless of size) and will ship separately from the wine.
- Pricing and Avaliability: Although the online inventory is always being maintained and updated, there are certain situations that may occur that are out of our control. Given the high volume nature of our business and the finite availability of some wines, please be aware that without notice there may be a vintage change or an out-of-stock situation with any of the wines that you order. Should that happen we would notify you by e-mail before your order is processed. All prices are subject to change without notice. Availability is subject to stock on hand. We are not responsible for typographical errors and reserve the right to correct any errors in pricing. We also reserve the right to limit quantities.
- Processing Time: It is our goal to process and ship all orders as quickly as possible. Most orders will be processed within 24-48 hours of being placed. There are several factors that contribute to when you will receive your order once it has been placed. The timing in which your order is processed is determined by the accuracy of the information provided on the order, when the order is placed, order volume, and stock availability. We do not ship UPS Ground or 2Day packages past Wednesday or Overnight packages past Thursday. Please contact us If you would like it sent on a future date.
- Payment: We accept Visa, MasterCard, American Express and Paypal only. Credit cards will not be charged until all customer info has been verified and product is in stock and ready to ship. If you take advantage of the summer free wine storage, the credit card will be charged before storage.
- Sales Tax : 8.975% sales tax if your wine will be shipped to or picked up from California.
Wine Refund Policy:
- BY LAW, we are unable to accept returns on wine unless the product is corked or flawed.
- Corked or flawed bottles: If you suspect the bottle is bad, please just put the cork back in the wine leaving the contents of the wine in the bottle. We can't take back any empty bottles! We willmake every effort to replace the bottle with same vintage, however due to the limited supply of many wines another vintage or comperable substitute with be exchanged.
- On older vintages, we make every effort to secure wines that are in top condition, and we do not accept questionable goods. For wines that are five years old or older, it is the industry standard and the policy of Nick's Wine Corner that such wines are purchased at the buyer's risk in case of a problem.
- Order Error: If you find any errors regarding type of wine and vintage, please call our order department (888-229-0656) or send an e-mail to info@NicksWineCorner.com right away. NicksWineCorner.com will arrange to have the package picked up and returned to us right away for inspection. Once the package is returned to us, we will inspect the contents and then send out a replacement package to you. For this reason, it is vital that you let us know of any error immediatly to ensure the fastest delivery of your new shipment.

- These Terms and Conditions of Sale, as well as your and our respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of California. You consent to the exclusive jurisdiction with any wine purchased from us. In no event shall our liability ever exceed the purchase price actually paid by you for such wine.
